Force Majeure Policies

“Force Majeure Event” means an event beyond the reasonable control of a party, that could not reasonably have been foreseen at the time of the reservation and whose effects could not reasonably have been avoided or overcome, including but not limited to:

  • pandemics or public health emergencies
  • war, terrorism, civil disturbance and/or geopolitical instability
  • governmental action, including government-imposed business and/or travel restrictions
  • natural disasters, fire, flood, earthquake
  • prolonged break-down/disruption of transport.

No party shall be held liable for failure or delay in the performance of its obligations due to a Force Majeure Event.

Should a Force Majeure Event affect Borgo Pignano Hotels, the latter will inform guests as soon as possible, by explaining the situation and the expected impact on their reservation or stay and will cooperate to try mitigating such impact.

Should Borgo Pignano be unable to perform its obligations due to a Force Majeure Event, Borgo Pignano may cancel the reservation and may offer guests alternatives (such as a date change or a voucher) to the monetary refund of any payment they have already made to Borgo Pignano, in any case without further liability and without guests being entitled to additional compensation, damages or reimbursement of any consequential costs. In no cases guests will be required to complete payments for services that cannot be provided.

In case a Force Majeure Event affects a guest, Borgo Pignano will be entitled to ask the guest to provide valid documentation or official proof (such as government advisories, travel restriction official notices etc.), to demonstrate the causal link between the cancellation and the Force Majeure Event. Upon verification, Borgo Pignano may cancel the reservation and the same discipline as the previous paragraph will apply, mutatis mutandis.For assistance or to submit documentation, guests are encouraged to contact Borgo Pignano directly.
